Terms and Conditions

Effective as of August 1st 2025.

These Terms and Conditions govern all purchases made from Ema Viačková, IČO 17485401, registered at Buližníková 932/10, 182 00 Praha-Ďáblice, Czech Republic ("we", "us", "our").

By placing an order on our website, you agree to these terms.

1. Products

We offer handmade ceramic products, including made-to-order and personalized items. Due to the nature of ceramics, slight variations may occur between pieces. There is no age restriction on purchasing from our webshop.

2. Orders

  • Orders are confirmed via email once received.

  • Changes or cancellations are not possible after placing the order.

  • By placing an order, you confirm that all information provided is accurate.

3. Pricing & Payment

  • All prices are listed in Czech crowns (CZK).

  • We are not VAT-registered; prices are final and VAT does not apply.

  • We accept payments via card and Apple Pay.

  • Invoices are issued for every order.

4. Shipping & Delivery

  • We currently ship within the European Union.

  • Made-to-order items are dispatched within approximately 1 month.

  • Estimated delivery time is 7 days after shipping.

  • Shipping is carried out by Zásilkovna/Packeta where possible, or UPS for other destinations.

  • Any customs duties or import taxes are the responsibility of the customer.

  • Local pickup is not available.

5. Returns & Refunds

Returns

  • Returns are accepted in accordance with applicable EU consumer laws.

  • The return period is 14 days from the day you receive your order.

  • To be eligible for a return, items must be unused and in their original packaging.

  • Return shipping costs are the responsibility of the customer.

Non-returnable items

  • Personalized or made-to-order items are non-returnable, except in cases of damage or legal warranty claims.

Damaged items

If your item arrives damaged:

  • Please contact us at em.via.atelier@gmail.com within 48 hours of delivery.

  • Provide clear photos of the damaged item and the packaging.

  • We will offer a replacement if available, or a full refund if not.

  • Please retain all packaging materials until the shipping claim is resolved.

6. Intellectual Property

All content on this webshop—including product images, designs, descriptions, branding, and text—is the intellectual property of Ema Viačková. You may not reproduce, copy, or use this material without written permission.

7. Data Protection

  • We collect only the data necessary to process your order and fulfill invoicing requirements (e.g., name, address, email).

  • Payment information is processed securely via third-party providers (e.g., Apple Pay, card processors).

  • We do not store your payment details.

  • We send newsletters and promotional emails only to those who opt in; you can unsubscribe at any time via a link in the email.

8. Changes to Terms

We reserve the right to update these Terms and Conditions at any time. Changes will take effect upon publication on our website. Your continued use of the webshop implies acceptance of the updated terms.

9. Governing Law

These terms are governed by the laws of the Czech Republic. Any disputes shall be subject to the jurisdiction of Czech courts.
